Grandma Kim King-Macon, 47, continued driving on to the shopping mall after Gary Holmes fired into her car without checking on her grandson Acen King in the back seat which cause the child to "bleed out" from his gunshot wound
Assistant US Attorney Patrick Harris said late Thursday that the man had been taken into custody, the Arkansas Democrat Gazette reported.
US Marshals worked with Gary Holmes' parents to assist with the 33-year-old's surrender to Little Rock authorities, according to Fox 16.
Holmes was booked into jail for one charge of capital murder and two charges of terroristic act, online records show.
Police say Acen King was being taken on a shopping trip by his grandmother on December 17 when a driver opened fire on the grandmother's car because he thought she 'wasn't moving fast enough at a stop sign'.
The grandmother, who wasn't struck, drove away and called police from a shopping center.
The boy was taken to a hospital, where he died shortly after.
